Miami Immigration Lawyer Seeks Green Card for Non-Citizen

Jonathan A. Bartell plans to help an abused non-citizen obtain a green card since he was abused while in custody.


The legislation is designed to protect imprisoned people in immigration detention centers, according to information from a story about an illegal immigrant who was sexually abused in prison.


Within the past five years, about 200 sexual abuse complaints were filed with the federal government about immigration detainees seeking prison rape protection. Physical abuse is a problem, but

an ACLU official said the numbers are under-reported as many detainees cannot report the abuse since they do not speak or read English well, or know their legal rights while in the U.S.
Consular processing lawyer Bartell represents a man, in the U.S. illegally, who was detained by

immigration officials. He was physically abused in jail.


"While in detention, he was severely beaten by another inmate," Bartell said. "This inmate was in jail for a criminal violation, yet he was being held in the same area as the non-criminal

immigration inmates."


Bartell, who specializes in cancellation of removal issues,

said he will attempt to get his client a green card as a victim of crime.


"My goal is to protect people," the business immigration attorney said.


Bartell's client's case is like the above referenced case of the immigrant detainee, awaiting deportation to India, who was sexually abused by three gang members while at a jail in Illinois. He came

to the U.S. on a work visa, but was taken into federal custody at work by immigration officials since he overstayed his visa.
He spent many years behind bars where he suffered the abuse that he reported but wasn't taken seriously. Although, the man was eventually released when he got an immigration lawyer, he is

still fighting to remain in the U.S. with his wife and kids, and get a visa available to victims of crime.
