Judge calls legal fees grossly excessive

Auckland 6 October 2006- Fees charged by Auckland Lawyer & community board member Herbert Romaniuk have found to be grossly excessive by Wellington High Court Judge Forrest Miller.

Mr Romaniuk had presented an account of $19,473.12 although he played a limited role in the litigation and had not attended a single hearing. The Judge said that a reasonable fee in his case could not exceed $3000.

One of the parties to the dispute, Mr John Creser said; “Herb doesn’t deserve a cent, if the Court had followed previous rulings, none of the unsuccessful parties should be paid. Why should losing lawyers be well rewarded, when beneficiaries of the estate in the same position find themselves adjudged bankrupt? ”

“This might be the kind of money he’s been able to extort from his Mr Asia clients like Peter Fulcher but even 3k is too much for nonsensical befuddled ramblings which included reference to one person with four different spellings on the same page!”
