Northumberland Council has lost an appeal against the EAT after a £100,000 payout to an Asian council worker during a Race Discrimination Case. Wolstenholmes Employment Solicitors have been following the case closely as they currently represent a number of similar clients.

Rosene Railton was forced to take sick leave and early retirement from a job she loved after being harassed and bullied by her manager. The discrimination case tribunal in Northumberland heard how she was subjected to unfair treatment over a sustained period of six months, ultimately resulting in her retirement in November 2008.

The discrimination case tribunal concluded that the discrimination was racially motivated on a ‘subconscious level’. Employment Solicitors have been monitoring the case:

“A complaint about race discrimination in employment must be brought to an Employment Tribunal within three months of the act,” advises Benjamin Robert Bee, Employment Law specialist at Wolstenholmes Employment Solicitors. “When things go wrong in the employer/employee relationship it is vital to get legal advice without delay.”

Discrimination is not limited to racial motives. It could be on the grounds of gender, sexuality, age, marital status, or disability. There are Acts in place to protect those being unfairly treated, such as the Race Relations Act 1976. Keep a diary of any form of harassment or bullying. Keep documentary evidence such as memos or emails. To be successful in a Race Discrimination case you must show that you were being treated less favourably than someone of different racial or national origins and prove that you suffered some disadvantage as a result of your treatment.
