Elective Plastic Surgery in New Jersey Is Soon to Be Tax-Free

Pressbox (Press Release) - EDISON, NEW JERSEY - During a legislative session in January, New Jersey Governor Chris Christie decided to review an 8-year-old 6 percent tax on elective plastic surgery (http://www.associatesinplasticsurgery.com/) in New Jersey.

In an effort to raise funds in the state, the tax on cosmetic and plastic surgery was passed in 2004. It was initially estimated that the new tax would bring in $25 million in the first year, but it only brought in $7 million. The law includes only cosmetic procedures that are focused on improving the patient's appearance and do not promote proper function of the body or prevent or treat illness or disease.

"A person can come in with breathing problems and have nasal surgery performed to correct the issue and are not required to pay the tax," said Dr. Andrew Miller a New Jersey plastic surgeon (http://www.associatesinplasticsurgery.com/plastic_surgeon_Julie_Miller.html) who specializes in rhinoplasty (http://www.associatesinplasticsurgery.com/rhinoplasty.html). "But that same person can come in and want nasal surgery to improve their self-confidence and have to pay the tax. It's nonsense."

The main reason the tax failed to bring in as much as the state anticipated is because patients were driving to nearby states to get a better rate and avoid the tax.

"People still came to our New Jersey facilities to have their procedures done, but they complained a lot," said Miller, a breast implant (http://www.associatesinplasticsurgery.com/breast_implants.html) expert.

Complaints were usually about being taxed twice because they typically paid with their net income, which is money they were already taxed on in their paycheck. Not only are they trying to stimulate the economy, but they are trying to improve themselves as well and this law didn't sit well with them, said Miller.

"I was never a fan of this law and I will be glad when it is phased out," said Miller.

The 6 percent tax will be phased out gradually between now and July 2013, reducing 2 percent immediately, then an additional 2 percent in July and again until it is gone.
