'Attorney-General Successfully Joined in the Carrickmines Castle case today'

This morning, in the Masters Chambers of the High Court, the Attorney General of Ireland was officially joined in the Carrickmines Castle case, which will now be styled: "The Attorney General, at the Relation of Dominic Dunne and Gordon Lucas -vs- Dún Laoghaire-Rathdown County Council."

On 24 February 2003, the Supreme Court made an interlocutory order restraining Dún Laoghaire-Rathdown County Council from carrying out further works at or around Carrickmines Castle. In its judgment, the Court implicitly suggested the Plaintiffs to apply to the Attorney-General to request his involvement in the proceedings given the public nature of the rights at issue. That application was duly made and was heard by the Master of the High Court this morning.

A Relator action is described on the web site of the Attorney General:

"In some legal cases the litigant may wish to enforce public rights - by claiming for example a public right of way or that there is a public nuisance. To avoid any lack of legal standing, or locus standi as it is called, by the litigant to bring such legal cases, the Attorney General may give his consent, or his fiat as it is called, to such proceedings being taken in appropriate cases. Such cases are called relator actions where the Attorney General sues at the
relation of the applicant. However, while the Attorney General is the nominal plaintiff where he gives his consent to do so, it is the applicant who brings the case and takes all the risks associated with litigation both in terms of winning or losing the case and in terms of costs.

According to Mr Vincent Salafia, Spokesperson for Carrickmines Castle Preservation group:

"The successful addition of the Attorney General, on the side of the preservationists, certainly adds to
the gravity of the case. This affirms the importance of the public rights at stake, particularly with regards to the status of a National Monument under the
National Monuments Act."
